Background of the Study
Inheritance disputes often arise from contested claims regarding the legitimacy and identity of heirs. In Nsukka Local Government Area, Enugu State, forensic anthropology plays a pivotal role in resolving such conflicts by providing scientific evidence through skeletal analysis, dental records, and DNA profiling (Ife, 2023). These methods help establish biological relationships and verify personal identities when documentary evidence is insufficient or disputed (Nwachukwu, 2024). The application of forensic techniques in inheritance cases has been further refined by integrating modern technologies such as computerized imaging and genetic analysis, which enhance the precision and reliability of forensic evidence (Chinonso, 2025). However, challenges persist due to cultural sensitivities, ethical dilemmas, and inconsistencies in record management. This study critically assesses the forensic anthropological approaches used in inheritance disputes and aims to propose methodological improvements that can streamline evidence collection and interpretation, ultimately ensuring fair legal outcomes.
Statement of the Problem
Inheritance disputes in Nsukka are complicated by the limitations of traditional identification methods and the inconsistent application of forensic anthropological techniques (Chinonso, 2025). Inadequate record keeping and ethical controversies further complicate the verification of heirs, leading to prolonged legal conflicts. These issues undermine the reliability of forensic evidence and impede the fair resolution of inheritance claims. This study seeks to identify the challenges in current forensic methodologies and propose enhanced strategies to improve the accuracy and acceptance of forensic evidence in inheritance disputes (Ife, 2023).
Objectives of the Study:
To assess the role of forensic anthropology in resolving inheritance disputes.
To identify the challenges affecting the reliability of forensic evidence in such cases.
To recommend methodological improvements for more accurate heir identification.
Research Questions:
How effective are forensic anthropological methods in resolving inheritance disputes?
What challenges affect the reliability of forensic evidence in these cases?
What strategies can enhance forensic practices in inheritance dispute resolution?
Research Hypotheses:
H1: DNA profiling and modern imaging significantly improve heir identification accuracy.
H2: Inconsistent record management adversely affects forensic evidence reliability.
H3: Standardized forensic protocols enhance the resolution of inheritance disputes.
Significance of the Study
This study is significant as it informs legal and forensic communities on the critical role of forensic anthropology in resolving inheritance disputes. Its findings will lead to improved evidence collection protocols, reduced legal ambiguities, and enhanced fairness in inheritance resolutions, thereby bolstering trust in forensic methodologies (Nwachukwu, 2024).
Scope and Limitations of the Study:
This study is limited to evaluating forensic anthropological approaches in resolving inheritance disputes in Nsukka Local Government Area, Enugu State. It does not extend to other legal aspects of inheritance law.
Definitions of Terms:
Inheritance Dispute: A conflict arising from contested claims over a deceased person’s estate.
Heir Identification: The process of establishing the rightful beneficiary of an inheritance.
Forensic Anthropology: The scientific application of anthropology to legal investigations.
